Resumen

On 1 june 2015, the directive 67/548/eec of 27 june 1967 on the approximation of laws, regulations and administrative provisions in the area of classification, packaging and labelling of dangerous substances, was repealed and replaced by commission regulation (EC) no. 1272/2008 of the european parliament and of the council of 16 december 2008 on classification, labelling and packaging of substances and mixtures, amending and invalidate the directives 67/548/EEC and 1999/45/ec and amending council regulation (EC) no 1907/2006.

The adaptation of directive 97/23/EC to regulation no. 1272/2008, as well as the New Legislative Framework, was done through, 2014/68/EU of the european parliament and of the council of 15 may 2014, on the harmonisation of the laws of the member states on the marketing of pressure equipment, and which has been transposed in our legal system through the Royal Decree no. 709/2015, of 24 july, the government established the essential requirements of the security council for the marketing of pressure equipment.

In this regard, we need to align the current regulation of pressure equipment to the Royal Decree no. 709/2018, of 24 july.

In addition, and taking into account the experience in the implementation of this regulation it is necessary to modify of different points of the rules of procedure of pressure equipment in order to improve the proper application of the same.

Finally, and as indicated in the preceding paragraph, we need to adopt a new complementary technical instruction, not covered above, to address the installation, commissioning, regular inspections, repairs and modifications of pressure equipment, with maximum permissible pressure exceeding 0.5 bars, from lng terminals.

In accordance with article 26.6 of law 50/1997, of 27 november, the government, this provision is subject to the procedure for a public hearing.
