Summary
In accordance with the provisions of article 26.2 of Law 50/1997, of November 27, of the Government, the public consultation is carried out prior to the elaboration of the draft royal decree establishing the regulations for the direct granting of repayable advances in the form of loans to several companies for the technological and industrial development of several Special Programs for the Modernization of Missile Systems in the Aeronaval Domain.
Problems to be solved with the new standard
The draft royal decree aims to establish the rules governing repayable advances in the form of loans that will be granted by the Ministry of Industry and Tourism to the entities that the Ministry of Defense designates for Spanish participation in several Special Modernization Programs, in the field of missile systems for the naval and air field potentially covering TAURUS or NSM missiles, among others, along with other programs of study and evolution of missile systems. The programs involve technological and industrial developments in various areas.
This project will be prepared in accordance with the provisions of article 28.2 of Law 38/2003, of 17 November, General Subsidies, the Government will approve by royal decree, on the proposal of the competent minister and after a report from the Ministry of Finance, the special rules regulating subsidies regulated in paragraph 2 (c) of article 22 of this law.
Need and opportunity for approval
The purpose advocated by the initiative must necessarily be addressed through a Royal Decree in accordance with article 28 of Law 38/2003, of November 17, General of Subsidies.
Objectives of the norm
The rule will regulate, among other aspects, the following:
- Definition of the object of the repayable advance, indicating the singular nature of the same and the reasons that accredit the public, social, economic or humanitarian interest and those that justify the difficulty of its public convocation.
- Applicable legal regime.
- Beneficiaries and modality of aid.
- Procedure of concession and regime of justification of the application given to the aid by the beneficiaries and, where appropriate, collaborating entities.
