In accordance with the provisions of article 26.2 of Law 50/1997, of November 27, of the Government, the public consultation is carried out prior to the elaboration of the draft royal decree establishing the regulations for the direct granting of a loan to the company Hisdesat Servicios Strategic, S.A., for the development and launch of the communications satellite SPAINSAT NG 3.

The draft royal decree aims to establish the regulations for the direct granting of a loan to the company Hisdesat Servicios Democrática, S.A. (hereinafter Hisdesat) by the Ministry of Industry and Tourism for the development and launch of the communications satellite SPAINSAT NG 3. This satellite is a strategic element in the communication capabilities of the Ministry of Defense and the Armed Forces and seeks to replace the satellite SPAINSAT NG 2, which was fatally damaged during the orbit phase, in order to ensure that the Armed Forces have all the necessary capabilities in terms of government communications.

This project will be prepared in accordance with the provisions of article 28.2 of Law 38/2003, of 17 November, General Subsidies, the Government will approve by royal decree, on the proposal of the competent minister and after a report from the Ministry of Finance, the special rules regulating subsidies regulated in paragraph 2 (c) of article 22 of this law.

The purpose advocated by the initiative must necessarily be addressed through a Royal Decree in accordance with article 28 of Law 38/2003, of November 17, General of Subsidies.

The rule will regulate, among other aspects, the following:

1. Definition of the object of the repayable advance, indicating the singular nature of the same and the reasons that accredit the public, social, economic or humanitarian interest and those that justify the difficulty of its public convocation.
2. Applicable legal regime.
3. Beneficiary and modality of aid.
4. Procedure of concession and regime of justification of the application given to the aid by the beneficiary and, where appropriate, collaborating entities.
