In accordance with the provisions of article 26.2 of Law 50/1997, of November 27, of the Government, the public consultation is carried out prior to the elaboration of the draft royal decree amending Royal Decree 1008/2022, of December 5, which establishes the regulations for the direct granting of a loan to the company Airbus Defence and Space, S.A.U., for the Euromale RPAS program.

The draft royal decree aims to modify the payment schedule of the current Royal Decree 1009/2022, of December 5, to align it with the reality of the execution of the program, shifting the annuities without altering the total amount of the loan, since, due to various technical vicissitudes suffered by the program, the aforementioned schedule has been outdated with current needs.

This project will be prepared in accordance with the provisions of article 28.2 of Law 38/2003, of 17 November, General Subsidies, the Government will approve by royal decree, on the proposal of the competent minister and after a report from the Ministry of Finance, the special rules regulating subsidies regulated in paragraph 2 (c) of article 22 of this law.

The purpose advocated by the initiative must necessarily be addressed through a Royal Decree since to modify a norm of regulatory rank another norm of similar or greater rank is required.

The regulation will modify the schedule of pre-financing grants granted to Airbus Defence and Space, S.A.U., which regulates Royal Decree 1008/2022 of 5 December, which establishes the regulations governing the direct granting of a loan to the company Airbus Defence and Space, S.A.U., for the Euromale RPAS program.

The modification is consistent with the current implementation rates of the program and with the planning of the Ministry of Defense.
