Background of the norm

With the objective of improving the competitiveness of Spanish shipyards, the royal decree 442/1994, 11 March on bonuses and funding to shipbuilding, and its successive modifications, established the framework of institutional support to improve the competitiveness of shipyards through aid in research, development and innovation.

To adapt the national standard regulator of the sector support in the form of direct aid in research, development and innovation to recent policy changes community, consolidate successive modifications of the text and separating the two aid instruments regulating the Royal Decree 442/1994 of 11 March, came the Royal Decree 873/2017, 29 September, which regulates the granting of aid to shipbuilding sector in research, development and innovation.

Problems to be solved with the new standard

The current regime of aid to shipbuilding in research, development and innovation, for the years 2016-2020, is based on the regulation (HAT) No 651/2014 of the commission, 17 June, declaring certain categories of aid compatible with the internal market in application of Articles 107 and 108 of the treaty, which applies has 31 December 2020. Therefore, the validity of the royal decree 873/2017, 29 September, ends on that date.

To give continuity to the special rules governing aid to the shipbuilding industry in research, development and innovation, and taking into account the future extension of the abovementioned Regulation until 30 December 2023, is necessary a modification of the royal decree expanding its duration until that allows the Rules.

Need and opportunity for approval

As subsidies directly requires a royal decree at the proposal of the Minister of industry, trade and tourism and receiving a report from the finance ministry, adopt special rules governing these aids after the period of the Royal Decree 873/2017, 29 September.

Objectives of the norm

To ensure the permanence of the shipbuilding sector English, key in the industrial fabric of certain regions of Spain, shipyards have specialised in obtaining innovative products that enable it to be competitive internationally.

Through this Royal Decree, gives impetus to shipbuilding enhance the innovative nature of the activity

Possible alternative solutions, regulatory and non-regulatory

There is No alternative regulatory not.

If there is changing policy proposal, once the duration of the Royal Decree 873/2017, 29 September, there would be the royal decree that article 28.2 of law 38/2003, of 17 November, General subsidies demands for subsidies directly, so that such aid would be deleted.
