Summary

In accordance with the provisions of article 26.2 of Law 50/1997, of November 27, of the Government, the public consultation is carried out prior to the elaboration of the draft royal decree establishing the regulations for the direct granting of repayable advances in the form of loans to the company NAVANTIA for the technological and industrial development of several Special Modernization Programs in the naval domain.

Problems to be solved with the new standard

The draft royal decree aims to establish the rules governing repayable advances in the form of loans that will be granted by the Ministry of Industry and Tourism to NAVANTIA, as a company that is expected to be determined by the Ministry of Defense for the execution of various Special Modernization Programs, among which are the “Spanish participation in the European Patrol Corvette program”, “Modernization and evolutionary development of Fleet Units” and “Modernization and evolutionary development of Cazamina Secure Class”. The programs involve technological and industrial developments in various areas.

This project will be prepared in accordance with the provisions of article 28.2 of Law 38/2003, of 17 November, General Subsidies, the Government will approve by royal decree, on the proposal of the competent minister and after a report from the Ministry of Finance, the special rules regulating subsidies regulated in paragraph 2 (c) of article 22 of this law.

Need and opportunity for approval

The purpose advocated by the initiative must necessarily be addressed through a Royal Decree in accordance with article 28 of Law 38/2003, of November 17, General of Subsidies.

Objectives of the norm

The rule will regulate, among other aspects, the following:

  1. Definition of the object of the repayable advance, indicating the unique nature of the advance and the reasons that accredit the public, social, economic or humanitarian interest and those that justify the difficulty of its public convocation.
  2. Applicable legal regime.
  3. Beneficiary and modality of aid.
  4. Procedure of concession and regime of justification of the application given to the aid by the beneficiary and, where appropriate, collaborating entities.
