Summary

The creation and regulation of the electro-intensive consumer figure provided companies in the industrial sector intensive in electrical consumption and at risk of carbon leakage with their own framework that helps mitigate the effects of high energy costs on their competitiveness.

Royal Decree 1106/2020, of 15 December, which regulates the Statute of electrointensive consumers, establishes the requirements to qualify for the category of electrointensive consumer, regulates the bases of the mechanism of compensation of the charges for the financing of the specific remuneration for renewables and high-efficiency cogeneration and for the additional financing in the non-peninsular territories and requires compliance with a series of obligations in the field of energy management, energy efficiency, decarbonization and renewable energy consumption.

Need and opportunity for approval

The high price of electricity weighs down the competitiveness of the industry, puts a brake on the electrification of processes and represents a risk of carbon leakage in many productive sectors.

The electricity prices observed by the industry in Spain are significantly higher than those of its main European competitors; instruments such as the compensatory mechanism regulated in the Statute aim to boost the competitiveness of the energy-intensive Spanish industry at risk of carbon leakage.

However, after five calls for aid, there is a marked fall in the compensation granted, so the Statute can be strengthened to guarantee the competitiveness of companies through a more efficient, effective and sustainable instrument over time.

Objectives of the norm

1. Promote the certification as an electrointensive consumer of all industrial installations intensive in electricity consumption and belonging to sectors at risk of carbon leakage, through the characterization of an electrointensive consumer adapted to the new reality of the Spanish electricity market.

2. Increase the recognised compensation for energy-intensive industrial installations at risk of carbon leakage, through the introduction of a new eligible cost in the compensatory mechanism regulated in Title III: the indirect contribution to the National System of Energy Efficiency Obligations reflected in the price of electricity supply.

3. Encourage the transition of subsidized industrial facilities towards efficient, emission-free and renewable electricity consumption, through a clear and proportionate system of obligations.

4. Reduce the processing time of the certification procedure as an electrointensive consumer, through a more agile and simplified exchange system with the System Operator.

5. Improve the system of monitoring of obligations, through a clear and proportionate reporting system.

Possible alternative solutions, regulatory and non-regulatory

The alternative solution would be to keep the text of the rule in force, but it is considered that the advantages of the modification to be undertaken will have an impact that is significant enough to justify the processing and approval of a regulatory rule.
