Resumen

The Regulation (CE) No 1907 / 2006 of the European Parliament and of the council, 18 December 2006, concerning the registration, evaluation, authorisation and restriction of chemicals (REACH), which establishes the European agency of chemical substances and preparations, amending Directive 1999 / 45 / CE and repealing Regulation (CEE) No 793 / 93 of the board and the rules (CE) No 1488 / 94 of the committee, as well as Directive 76 / 769 / CEE of the board and directives 91 / 155 / CEE, 93 / 67 / CEE, 93 / 105 / CE and 2000 / 21 / CE of the committee and its modifications, and the regulation (CE) No 1272 / 2008 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures, amending and repealing directives 67 / 548 / CEE and 1999 / 45 / CE and amending Regulation (CE) No 1907 / 2006 and its modifications, have established new classes and categories of danger that are not in their entirety correspond with those used in the current regulation of storage of chemicals.

On the other hand, the evolution of the technique and experience which has grown with the implementation of technical instructions, has highlighted the need to rewrite the whole regulation on storage of dangerous chemicals to adapt to new classes and categories of danger, and technical progress.

The new rules on storing chemicals, which approves with this Royal Decree, consists of a regulation and eleven instructions complementary techniques.

With regard to the previous regulation, this Royal Decree incorporates two new instructions complementary techniques, MIE APQ-0 “ general definitions ” which includes the definitions common to all instructions conoce complementary techniques to simplify them and unify at the same time definitions, and MIE APQ-10 “ storage of mobile containers ” which provides the technical requirements to those who have adjusted storage facilities, loading and unloading of chemicals in mobile containers.

This provision was dictates under Article 149.1.13ª Spanish constitution, which gives the State jurisdiction to determine the bases and coordination of the general planning of economic activity, without prejudice to the competence of the autonomous communities in the industry.

On the other hand and in accordance with Article 24.1.c) of the law 50 / 1997 of 27 November, the government, communicates that the draft royal decree is available for the fulfillment of its handling of public information.
