Resumen

In accordance with article 26.2 of the law 50/1997, of 27 november, the government, we shall now proceed to make the public consultation before the drafting of the draft royal decree makes provisions concerning construction products

Background of the norm

The present draft royal decree aims to develop certain aspects of the implementation of the futureEuropean regulation of construction products,that will replace the current regulation (EU) no. 305/2011 of the european parliament and of the council of 9 march 2011, laying down harmonised conditions for the marketing of construction products and repealing directive 89/106/eec.

The publication of the new european regulation in the official journal of the european Union is expected to take place in the coming months, once it has been completed the process, having already agreed a compromise text after the process of interinstitutional negotiations (trilogues) which took place during the second half of 2023, during the spanish presidency of the eu council (see more information in the following link:Proposal for harmonised conditions for the marketing of construction productsand having been adopted in the month of april in the european parliament (see link:European parliament legislative resolution of 10 april 2024).

Problems to be solved with the new standard

It is aimed to develop certain aspects of the future european regulation of construction products to be adopted without delay in the eu, and which will replace the current regulation (EU) No. 305/2011 of the european parliament and of the council of 9 march 2011, laying down harmonised conditions for the marketing of construction products.

Among the aspects of the european regulation developed include the sanctions regime, notification of evaluation bodies or the rules to apply for construction products which are not subject to the european regulation.

At the same time, it is intended to amend various national regulations relating to construction products whose content is been deprecated and should therefore be reviewed, updated or, where appropriate, repealed.

Below, any list of the regulation that could be subject to change, currently awaiting consideration:

  • Royal Decree 1313/1988 of 28 october, which declared compulsory harmonisationiraqi cementfor the manufacture of concrete and mortars for all kinds of works and prefabricated products.
  • Royal Decree 2,702 high/1985 of 18 december, which homologous thewirecorrugated smooth and employees in the manufacture of mesh and viguetas electrosoldadas semi-resistentes of reinforced concrete (viguetas in glass), by the ministry of industry and energy.
  • Royal Decree 2365/1985 of 20 november, which homologous theactive steel rebarfor concrete pretensado, by the ministry of industry and energy.
  • Royal Decree 2704/1985 of 27 december, which declared binding on all parties, the technical specifications, annexed to this royal decree forsteel tubesnominal diameters: comprising 8 mm and 220 mm and its derivatives, profiles for fluid handling applications, mechanical, structural and other uses, both in black as galvanized and its approval by the ministry of industry and energy.
  • Royal Decree 2367/1985 of 20 november, establishing the technical specifications subject to country teamsdetectors on the concentration of carbon monoxide.
  • Royal Decree 358/1985 of 23 january, establishing the technical standards subject to thegriferías healthfor local use of corporal hygiene, kitchens and washing-places and their approval by the ministry of industry and Energy.
  • Royal Decree 2351/1985 of 18 december, which declared binding technical specifications of the coatingsgalvanisedhot on products, parts and miscellaneous items which were constructed or manufactured with steel strong or other materials, and its approval by the ministry of industry and energy.
  • Royal Decree 842/2013, of 31 october, which approves the classification of construction products and constructive elements on the basis of their propertiesresistance and reactionfrontfire.
  • Royal Decree 605/2006 of 19 may, by the approved procedures for the implementation of the standard UNE-EN 197-2:2000 to iraqi cement not subject to the CE marking and distribution centres of any kind of cement.

Need and opportunity for approval

The requirements of this project is intended to cover royal decree, as indicated earlier, are to develop the necessary aspects of the new european regulation of construction products and update diverse national regulations relating to construction products.

Objectives of the norm

The objectives are the correct implementation of the new european regulation of construction products, as well as to adapt domestic regulations related to have been partly antiquated.

Possible alternative solutions, regulatory and non-regulatory

Are mainly the following alternatives:

  1. Limit the royal decree to the development of the european regulation of construction products.
  2. In addition to what is stated under (a), also include in the royal decree necessary modifications in national regulations relating to construction products.
  3. Do nothing.

The alternatives cited, it considers that the most suitable is b).
