Summary

The new Technical Regulation on the Safety of Gaseous Fuel Infrastructures and Installations aims to establish the technical conditions and guarantees that must be met by infrastructures and installations for the distribution, transport and use of gaseous fuels and gas appliances, in order to preserve the safety of people and goods.

This draft royal decree replaces the current Royal Decree 919/2006, of 28 July, approving the Technical Regulation on the distribution and use of gaseous fuels and its complementary technical instructions ICG 01 to 11.

The purpose of this royal decree is to update the technical regulations that are better adapted to the needs, possibilities and technical solutions currently available for gaseous fuel installations, based on the evolution of the technique and the experience that has been accumulated with the application of the current regulation, such as the need to include new gaseous fuels. It is also necessary to carry out a general review of the regulation that allows to clarify certain precepts of the content and thus solve problems of application of the same

They are also included in the scope of the other type of facilities whose regulations have not evolved over time, such as the case of storage, transfer and filling plants for liquefied petroleum gas containers or the case of installations for gaseous fuels by pipeline at maximum design pressure higher than 16 bar. In this way, it is intended to avoid regulatory dispersion, leaving the safety of the distribution and transport facilities of gaseous fuel under the same safety regulation.

In addition, this draft royal decree also updates various national regulations, specifically Royal Decree 552/2019, of 27 September, approving the Safety Regulations for refrigeration installations and their complementary technical instructions, Royal Decree 809/2021, of 21 September, approving the Regulation on pressure equipment and its complementary technical instructions and Royal Decree 337/2014, of 9 May, approving the Regulation on technical conditions and safety guarantees in high-voltage electrical installations and its Complementary Technical Instructions ITC-RAT 01 to 23.

In addition, this royal decree also repeals the following provisions: Royal Decree 919/2006, of 28 July, approving the Technical Regulation for the distribution and use of gaseous fuels and its complementary technical instructions ICG 01 to 11, the Order of 1 December 1964 approving safety rules for the construction, assembly and operation of the “Plants for the filling and transfer of liquefied petroleum gases”, the first additional provision of Royal Decree 984/2015, of 30 October, which regulates the organized gas market and the access of third parties to the facilities of the natural gas system, except for paragraph 7, the Order of 18 November 1974 approves the Gas Networks. Likewise, any provisions of equal or lower rank that are contrary to the provisions of this royal decree are repealed.

After the first hearing procedure initiated in March 2025, a series of claims were received that after their acceptance have led to substantial modifications, such modifications make it considered advisable to be subjected again to a public hearing procedure, limited in this case to the following sections:

  • ANNEX Minimum safety distances in hydrogen filling stations and section 3.1 Design of hydrogen filling station facilities, at ITC – ICG 05: INSTALLATIONS FOR THE SUPPLY OF GASEOUS FUELS FOR MEANS OF TRANSPORT.
  • ITC – ICG 06: LIQUEFIED PETROLEUM GAS (LPG) CONTAINER STORAGE FACILITIES FOR OWN USE.
  • Section 10 (Inspections) of the ITC-ICG 11: STORAGE, TRANSFER AND FILLING PLANTS FOR LIQUEFIED PETROLEUM GAS (LPG) CONTAINERS.
  • Final fourth and transitional seventh provisions on the adequacy of the regime of Fire Protection in Industrial Installations in the Regulation of Storage of Chemicals.

Structure of the Royal Decree

The royal decree consists of a preamble, a single article, six additional provisions, six transitional provisions, a derogatory provision and seven final provisions.

The regulation, which is intended to be approved by means of the aforementioned single article, consists in turn of thirty articles and thirteen Complementary Technical Instructions (ITC).

Submission of allegations

The allegations may be sent to the email address: participacion_csegind@mintur.es indicating in the subject: "Second Hearing RD Gaseous Fuels 2025"

In this second Hearing procedure, only claims relating to the major changes that have occurred in the draft Royal Decree project will be accepted, which are:

  • ANNEX Minimum safety distances in hydrogen filling stations (ITC – ICG 05).
  • ITC – ICG 06.
  • Paragraph 10. (Inspections) of ITC-ICG 11.
  • Final fourth and transitional seventh provisions on the adequacy of the regime of Fire Protection in Industrial Installations in the Regulation of Storage of Chemicals.

The claims must be presented using the attached document model (in .doc or .docx format that allows its management and edition), clearly ordering and separating the different comments made, and identifying the section and the text of the Royal Decree to which each one refers.

Only the responses in which the sender is identified will be considered, stating in them:

  • Name and surname/denomination or social reason of the participant
  • Organization or association (if applicable)
  • Contact (email).

In general, the contributions received will be considered to be open to public dissemination. The parts of the information submitted that, in the opinion of the interested party, should be treated confidentially and therefore should not be freely disseminated, should be specifically indicated in the text of the contribution itself, not considering for this purpose the generic messages of confidentiality of the information.
