Summary
Royal Decree 244/2016, of 3 June, implementing Law 32/2014, of 22 December, on Metrology, establishes in its sixteen annexes the general and specific requirements that must be met, among others, the measurement instruments subject to State metrological control. It also transposes the directives:
- DIRECTIVE 2014/32/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 26 February 2014 on the harmonisation of the laws of the Member States relating to the marketing of measuring instruments (recast)
- DIRECTIVE 2014/31/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 26 February 2014 on the harmonisation of the laws of the Member States relating to the making available on the market of non-automatic weighing instruments (recast)
This royal decree entered into force on June 8, 2016.
Directive 2014/32/EU of 26 February 2014 has recently been amended by Directive (EU) 2026/706 of the European Parliament and of the Council of 11 March 2026. Therefore, its transposition into the Spanish legal system is necessary.
The transposition makes certain aspects regulated in Order ICT155/2020, relating to measuring systems for electric vehicle power equipment and compressed gas pumps and electricity, gas and thermal energy meters, conflict with the new requirements established in Directive 2026/706. That is why it is necessary to amend Order ICT155/2020.
Need and opportunity for approval
The need to approve this Order is to match the requirements established in the national legislation regarding the measurement systems for electric vehicle power equipment and compressed gas pumps and electricity, gas and thermal energy meters, with the requirements established in DIRECTIVE (EU) 2026/706 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL, of 11 March 2026, amending Directive 2014/32/EU. In this way, Spanish manufacturers will not be required to have different requirements now than those that will be required when the transposition of Directive 2026/706 enters into force.
Objectives of the norm
To match the requirements of Order ICT155/2020, with the new requirements of Directive (EU) 2026/706 of the European Parliament and of the Council, of 11 March 2026, during the transitional period.
Possible alternative solutions, regulatory and non-regulatory
Not to make the normative proposal
