The current Fire Safety Regulation in industrial establishments, approved by Royal Decree 2267/2004, of December 3, aims to achieve a sufficient degree of safety in case of fire in establishments and facilities for industrial use.

To achieve this objective, the regulations in force so far, in 2004, establish the requirements that must be met by these establishments, so as to prevent the occurrence of fires, or if this is not possible, limit their spread and enable their extinction, minimizing the damages that the fire can produce to people or goods.

With this regulation, the then Ministry of Industry, Tourism and Commerce regulated the conditions of fire protection in industrial establishments on a horizontal basis, that is, applicable in any sector of industrial activity.

However, given the evolution in both the technique and the changes in the national and European regulatory framework, it is convenient to review and update the requirements established in Royal Decree 2267/2004.

Therefore, this draft Royal Decree seeks to update the regulatory framework related to fire protection, through the approval of a new Fire Safety Regulation in industrial establishments, which repeals and replaces the previous one.

The main cause that motivates the elaboration of this project of royal decree is the evolution that has occurred during the last years both in the technical and in the national and European regulatory framework.

Specifically, in relation to the European regulatory framework, the provisions of Regulation (EU) No 305/2011 of the European Parliament and of the Council of March 9, 2011, establishing harmonized conditions for the commercialization of construction products

There are also several national regulations that should be considered and taken into account, such as the Fire Protection Facilities Regulation, approved by Royal Decree 513/2017, of May 22; as well as the Technical Building Code (CTE), approved by Royal Decree 314/2006, of March 17 and modified several times, including by Royal Decree 732/2019, of December 20.

The needs that this royal decree project intends to cover, in accordance with the aforementioned, are to update the regulatory framework related to fire protection, through the approval of a new Fire Safety Regulation in industrial establishments, which Repeal and replace the previous one.

Adaptation of the national fire protection regulations to technical progress, as well as to the rest of the national and European regulatory framework.

Four possible alternatives are valued:

1. Preparation of a new regulation that repeals and replaces the previous one.
2. Partial modification of the current regulation of 2004.
3. Do not modify the 2004 regulations, and create supporting documents (guides) with the necessary clarifications and guidance, based on the existing regulations.
4. Do nothing.

Of alternatives cited, at this time it is considered that the most appropriate is 1.
