Resumen

The Directive 2014 / 94 / HAT of the European Parliament and of the council, 22 October 2014, concerning the implantation of an infrastructure for alternative fuels, establishes minimum requirements for the creation of an infrastructure for alternative fuels, including charging points for electric vehicles and points of natural gas refuelling (GNL and GNC) and hydrogen, to be implemented through action frameworks national member states.

This Royal Decree incorporates the Spanish legal system the said directive 2014 / 94 / HAT of the European Parliament and of the council, 22 October 2014. That is compliance with the obligation under article 288 of the treaty of operation of the European Union (former Article 249 of the Treaty establishing the European community) which provides that “ the directive will force the Member state addressee regarding the result to be achieved, leaving, however, to national authorities the election of the form and the means ”.

In particular, through this Royal Decree implements Article 11 of the directive to be transposed.

This royal decree establishes the need to develop a national policy framework that allows a reduction in the dependence of transport on oil, considering, according to the communication of the committee, 24 January 2013, « clean energy for transport: European strategy in the area of alternative fuels », electricity, hydrogen, biofuels, natural gas and liquefied petroleum gas (GLP), as well as its eventual simultaneous use and combined, for example through joint technology systems, the main alternative fuels with potential to replace the oil in the long term.

This provision was dictates under Article 149.1.13ª and 25th Spanish constitution, which gives the State jurisdiction to determine the bases and coordination of the general planning of economic activity, and databases energetic mining regime, without prejudice to the competence of the autonomous communities in the industry.

On the other hand and in accordance with Article 24.1.c) of the law 50 / 1997 of 27 November, the government, communicates that the draft royal decree is available for the fulfillment of its handling of public information.
