Summary

In accordance with the provisions of article 26.2 of Law 50/1997, of November 27, of the Government, the public consultation is carried out prior to the elaboration of the draft Royal Decree amending the Complementary Technical Instruction MI-IP02 "Oil Liquid Storage Parks".

Background of the norm

Royal Decree 2085/1994, of October 20, approving the Regulation of Oil Installations, approved the Complementary Technical Instruction MI-IP02 “Oil Liquid Storage Parks”.

Article 2 of the aforementioned Regulation provides that facilities intended to store liquid fuels or fuels and other chemicals interchangeably may be governed by:

  • this Regulation supplemented by the Chemicals Storage Regulation in respect of aspects applicable to products other than fuels or liquid fuels; or
  • by the Chemicals Storage Regulation.

However, while the Chemical Storage Regulation, as well as other related regulations have been updated recently, the last modification of the Complementary Technical Instruction MI-IP02 dates from 1998, through Royal Decree 1562/1998, of 17 July, which has caused the aforementioned ITC to be outdated in the face of the evolution of the other regulations, as well as that of the sector itself.

Need and opportunity for approval

While other reference (or complementary) regulations in the field of storage of products with characteristics similar to petroleum products have been updated recently, the ITC MI IP02 has not been updated since 1998, so it is considered necessary to carry out an amendment to prevent the regulation of petroleum products in this field from being outdated.

Objectives of the norm

The objective of the standard is the adaptation of the regulations on the safety of storage of petroleum products to the evolution of the technique and the sector, as well as the experience that has been accumulated with the application of the same and other related regulations.

Possible alternative solutions, regulatory and non-regulatory

There are no non-regulatory alternatives to adapt the industrial safety regulations for the storage of petroleum products, so the only alternatives are:

  • Carry out the modification of the Complementary Technical Instruction; or
  • do nothing.
