Summary
This initiative is part of a package of measures aimed at removing regulatory barriers to driving electric light commercial vehicles.
Council Directive 92/6/EEC requires the installation and use of speed limitation devices on certain heavy goods vehicles. Electric light commercial vehicles are heavier than their combustion equivalents due to the weight of the battery. Although they have the same load capacity and the same uses as a light commercial vehicle with an internal combustion engine with a maximum authorised mass of less than 3.5 tonnes, the additional weight of the battery means that they fall within category N2 and therefore within the scope of the legislation requiring the installation of speed limitation devices – Regulation (EU) 2019/2144 of the European Parliament and of the Council and Directive 92/6/EEC. The proposal amends Article 3 of Directive 92/6/EEC to exempt category N2 electric vans, with a maximum authorised mass exceeding 3.5 tonnes and up to 4.25 tonnes, from the obligation to install and use speed limitation devices.
Regulation (EU) 2019/2144 is amended in a parallel legislative proposal exempting the aforementioned vehicles from the obligation to equip speed limitation devices.

In order to identify the aspects of the legislative proposal that have the greatest impact for Spain and encourage the participation of the citizens and national sectors affected, a public participation process is opened to obtain comments on the proposal for a regulation that is attached as an annex.
