Resumen

In accordance with article 26.6 of law 50/1997 of 27 November, the government, we proceed to make the public hearing on draft royal decree approves Additional Technical instruction AEM 1 "LIFTS » rules of lifting and maintenance, approved by Royal Decree 229/1985 of 8 November.

This rule has been developed taking into account the principles that make up the good regulation, referred to in Article 129 of law 39/2015, 1 October, Common Administrative Procedure of public administrations.

In particular, the principles of necessity and effectiveness to Be that the adoption of this Royal Decree is the necessary tool for achieving the objective is to update the rules of industrial safety in Spain regarding the maintenance, inspection and modernization of the existing hoisting appliances. The principle of proportionality is considered fulfilled whenever the royal decree contains the necessary regulation to meet their purpose.

The objective is the adaptation of safety regulations of elevators, establishing technical requirements affecting the maintenance and regular inspections; improve regulation taking into account the evolution of the technique and experience which has grown with the implementation of the same which obliges reconsider the ways in which to conduct revisions of maintenance.

Likewise, it has been considered necessary to include a series of minimal measures that improve the safety of existing elevators based on the new technical regulations in force at the time of the publication of this Royal Decree.

The draft royal decree consists of a preamble, a single article eight additional provisions, three transitional provisions, a Unique derogation provision and two final provisions.
