Background of the norm

The council of the European Union agreed on 21 july 2020 a package of far-reaching measures, which brings together the multiannual financial framework (MFF) for 2021-2027 and include a european instrument for recovery (Next Generation EU), whose focus is on the mechanism for the recovery and resilience. To access financial resources of this mechanism, member states should prepare a plan aimed at recovery. Spain submitted to the European commission for its Recovery Plan, Transformation and Resilience (hereinafter, “ Plan for recovery ”), which was adopted by decision of the Implementation of the council relating to the adoption of the evaluation of the recovery Plan and resilience in spain last july 2021 (hereinafter referred to as “ CID ” by its initials in english).

According to the CID, the line of this aid regulated by Royal Decree is therefore part in pillar 12 “ Industrial Policy Spain 2030 ”, 2 “ Investment Programme to promote the competitiveness and sustainability ” of the Industrial Recovery Plan. This investment includes support for strategic projects for industrial transition, whose principal objective is to drive the transformation of the strategic value chains of industrial sectors with great pull in the economy, and in line with the european strategy for industrial ecosystems.

Chapter III, title II of the royal Decreto-ley/2020, 36 of 30 december, certain measures urgently to the modernization of public administration and for the implementation of the recovery Plan, contains a new concept of public-private partnerships, strategic projects for the recovery and Economic Transformation (LOSS). Within this figure are grouped projects with a tractor structural transformative impact on strategic sectors or phases of research and innovation disruptive and ambitious, beyond the state in the sector.

The agreement declares as strategic project for the recovery and Economic Transformation Industrial decarbonisation of the manufacturing industry, adopted by the council of ministers on 27 december 2022, recognizes that there are circumstances necessary to declare this project as a strategic project for the recovery and economic transformation, in accordance with article 8 of the royal Decreto-ley/2020, 36 of 30 december.

The memory of the narrative of the recovery and Economic Transformation decarbonisation of Industrial manufacturing (HUGE Industrial Decarbonisation) provides for the establishment of four processing steps. The first is an integrated action programme aid for decarbonisation of the manufacturing industry, whose purpose will be granting aid in the form of loans, grants or a combination of both, which may be concurrently simple, to promote the reduction of direct production processes and efficiency of the industrial plants, as well as the r & D & I projects aimed at developing technologies and scale needed to achieve the objectives of decarbonisation.

Problems to be solved with the new standard

The manufacturing industry 11.3 per cent of gdp of Spain, but, however, is responsible for 24 per cent of the end use of energy, from 22 per cent of the final consumption of fossil fuels (taking into account only energy uses) and 21 per cent of total emissions of greenhouse gases. Therefore, the decarbonisation of its processes is essential to achieving the objective of neutrality in 2050.

The industry has made significant efforts in decarbonisation, but remains largely dependent on fossil fuels, especially in those processes that require high temperatures. The situation and the pace of current investments are not sufficient to achieve the objectives of combating climate change by 2030 and 2050, so it is essential to promote industrial investment in this direction.

This rule sustanciará processing the first step of the HUGE Industrial Decarbonisation.

Need and opportunity for approval

The objective of the rule is to adopt a system of aid, on a competitive, with simple window open, to promote the decarbonisation of the processes of the manufacturing industry in the framework of the recovery Plan transformation and Resilience.

The aid system will be forwarded to the support of strategic projects within a certain size to undertake manufacturing industrial enterprises, individually or in collaboration with other, which can be held in solitary emission rights or not. The main objective is to support investments for the reduction of emissions in the industrial facilities. In case of consortia, in addition to manufacturing industrial enterprises, may participate in the same other industrial enterprises do not necessarily participate in the achievement of the projects.

It is necessary in the form of Royal Decree to this regulation, in order to be able to respond to the granting of direct intersection simple of aid which meet the requirements and overcome the thresholds set out in the royal decree.
