Background of the norm

The publication of the royal decree 948/2003 of 18 july, which prescribes the minimum conditions to be met by washing facilities or dewatering and slope depressurization degasification, as well as the repair or alteration of dangerous goods, introduced their eligibility washing facilities or tank degasification of dangerous goods.

Subsequently, by the orderITC/2765/2005 of 2 september, were updated annexes I, II and IV of the aforementioned royal decree, to bring up to date the skill requirements to washing facilities inside tanks of dangerous goods and technical procedures dewatering and slope depressurization degassing. Finally, the royal Decree No. 340/2010, of 19 march, amending royal decree to adapt the provisions of directive 2006/123/Ec of the european parliament and of the council of 12 december 2006, on services of the internal market (Directive on services).

Problems to be solved with the new standard

The experience accumulated over the implementation of the royal decree 948/2003, had highlighted the need to update the provisions relating to periodic monitoring which are subject to washing facilities or dewatering and slope depressurization degasification, as well as the repair or alteration of dangerous goods, with the aim of ensuring compliance with the provisions required to such facilities by regulation.

In addition, it is intended to adapt the standard terminology related to repairs and modifications, as well as the procedures to continue to carry out these operations, with the requirements of the regulations in force on collection of cisterns in agreements concerning international carriage of dangerous goods (ADR,PID…).

Finally, there is a need to revise the technical requirements applicable to such facilities to align them with technological developments and current normative framework.

Need and opportunity for approval

The updating of the royal decree 948/2003 of 18 july, which prescribes the minimum conditions to be met by washing facilities or dewatering and slope depressurization degasification, as well as the repair or alteration of dangerous goods, will adapt the spanish regulation in the area of washing facilities interior as well as repair of tanks of transport of dangerous goods to the evolution of the technique to contribute to ensuring the safety and environmental protection.

Objectives of the norm

The fundamental objective of this rule is to incorporate improvements identified since the entry into force of the royal decree 948/2003, aligning the applicable requirements with the regulations applicable in respect of the transport of dangerous goods.

Possible alternative solutions, regulatory and non-regulatory

Score four alternatives:

  1. Development of a new regulation which repeals and replaces the previous one.
  2. Partial modification of the current regulation of 2003.
  3. Do nothing.

These alternatives, it considers that the most suitable is b)
