Summary
This royal decree aims to ensure correct application in Spain of two essential community regulations to ensure the strategic autonomy of the mining industry and in the european Union:
- The Rules Of Procedure (EU) 2024/1252 of the european parliament and of the council of 11 april 2024, establishing a framework to ensure a sustainable and safe delivery of key raw materials and amending regulations (EU). 168/2013,(EU) 2018/858, (EU) 2018/1724 and (EU) 2019/1020 (known as « Law of key raw materials' or ' CRMA ' by its initials in english)
- The Rules Of Procedure (EU) 2024/1735 of the european parliament and of the council of 13 june 2024, establishing a framework of action to strengthen the european ecosystem manufacturing technologies net zero emission and amends the rules of procedure (EU) 2018/1724 (known as « Law of the zero emissions industries net "or" NZIA 'by its initials in english).
Despite the direct applicability of the regulations in the territory of the european union, the adoption of this rule is necessary to comply with the obligations that both regulations placed upon the Spanish state. It also guarantees the right into the spanish constitutional framework, in particular as concerns the system of distribution of competences between the General state administration and the autonomous communities.
It should be noted that the two aforementioned eu regulations, even with their differences, remain a similar structure and contain parallel provisions, each within its sphere of application. The key raw materials are essential for the value chains for many industries net zero emissions, which will produce synergies between the two regulations, that this rule is enhanced.
Chapter I regulates the implementation of CRMA. definition of the contact points. Chapter II regulates the implementation of NZIA first section defines the Unique contact points and questions relating to the granting of authorizations and permits for cleaner production projects net zero emissions. The second section outlines the procedures necessary for the recognition of strategic projects net zero emission and valleys of acceleration. The ministry of Industry and tourism will be competent to recognize the strategic nature of projects of net zero emission, in collaboration with the autonomous community in which to locate the project. It evacuated to the national legal system the effects that article 15 of the ‘ NZIA" recognizes strategic projects. It also regulates the administrative procedure (general or simplified) for the statement of net zero emissions. Section 3 defines the information requirements of the various ministerial departments of the General state administration and its agencies linked or dependants, as well as the autonomous communities, to ensure compliance with the reporting and follow-up NZIA Finally, the fourth division creates and regulates the committee on coordination to promote projects net zero emissions.
Finally, in the final provisions on time amending royal decree 975/2009 of 12 june, to introduce the study of preliminary economic assessment on the possible recovery of key raw materials in the mining waste management and empowering the secretariats of state of energy and industry to make the necessary instructions for the preparation of reports of follow-up to the regulations CRMA and NZIA.
