Summary
The government of spain in april 2025, has launched an Industrial and technological Plan for security and defence in response to the international geopolitical context, the emergence of new hybrid threats and rethinking the atlantic alliance, in which there is a broad range of measures, including the launching of new Special Programmes of Modernization, requiring the pre-financing of the ministry of industry and tourism. The Plan, among others, have a positive impact on employment and promote a new wave of technological innovation and industrial development.
This royal decree seeks to establish rules governing the granting of loans to entities designated by the ministry of defence in developing the programmes referred to in article 3.2 of this royal decree, on an exceptional basis and for reasons of public interest, social and economic spheres, as provided for in articles 22.2.c) and 28, paragraphs 2 and 3, of the act 38/2003 of 17 november, General subsidies.
The procedure for granting direct loans of this royal decree entities beneficiaries is based on rule 22.2.c) of act 38/2003 of 17 november, General grants, and is justified by the nature of the programmes, which are prepared to meet the needs of equipping the armed forces with the skills they require. Such programmes include the procurement of different types of defence by the ministry of defence, and by their very nature, required major prefinanciaciones beforehand to supply the goods and provide the services required to the armed forces. Given the high investments needed to address these programmes, its implementation would be impossible without the support of the General state administration in its funding. The ministry of defence is currently finalizing the process of determining the companies that develop programmes of this royal decree, so it would seem more appropriate to expect to such designation for the development of a royal decree of direct obtained. However, it becomes necessary for the adoption of this royal decree, since, given the time frame required for processing, the delay would do the same unable to execute unfunded, and therefore result in failure to implement the Plan Tecnológico Industrial security and defence policy. Moreover, given the urgent need to equip the Armed forces of the capacities to deal with complex geopolitical scenario remains meaning to the implementation of the regular procedure for awarding grants may seek to justify and on the above-mentioned direct.
The draft royal decree comprises a preamble, thirteen articles, two final clauses and nine annexes.
It consists of nine annexes contain Technical Memories of each programme.
