Summary

The draft royal decree aims to establish the regulatory rules for the direct granting of aid, in the form of a subsidy, corresponding to the “AUTO+ PROGRAMME”, created by Royal Decree-Law 7/2026 of 20 March, which approves the Comprehensive Plan of Response to the Crisis in the Middle East. This program aims to promote the decarbonization of transport by establishing new incentives for the acquisition in Spain of electric and electrified vehicles.

The draft royal decree distinguishes two different lines of financing: Line 1, intended for subjects who do not carry out an economic activity, and Line 2, intended for subjects who carry out an economic activity. Applications included in Line 2 shall be subject to the de minimis regime laid down in Commission Regulation (EU) 2023/2831 of 13 December 2023 and Commission Regulation (EU) No 1408/2013 of 18 December 2013 applying the aid limits and cumulation rules laid down in European Union legislation, as appropriate.

The aid provided for in the draft royal decree will be granted through calls made through ministerial orders of the Ministry of Industry and Tourism and will be financed from funds from the General State Budgets allocated to the State Secretariat of Industry of the Ministry of Industry and Tourism according to the budgetary items indicated in each call. In order to adequately provide the call for applications for 2026, article 34(8) of Royal Decree-Law 7/2026 of 20 March approves the granting of an extraordinary loan in the amount of 400 million euros for this purpose.

The geographical scope of the vehicle acquisition operations covered by the Auto+ programme, regulated by the draft Royal Decree, is the entire national territory. The aid will be granted directly, in accordance with Article 22.2.c and Law 38/2003, of November 17, and Chapter III of Title I of the Regulation of the General Law of Subsidies, approved by Royal Decree 887/2006, of July 21, since there are reasons of public, social and economic interest that do not allow to promote competitive competition.

The aid provided for in the draft royal decree may be applied retroactively to all vehicles that, fulfilling the conditions established therein, have been purchased in Spain from 1 January 2026.

The aid granted in accordance with the draft royal decree will not be compatible with other subsidies, income or resources in force for the same eligible costs, coming from the European Union, the General Administration of the State or its public or private entities. Nor will they be compatible with those subsidies or grants managed by the autonomous communities.

Structure of the Royal Decree project

The draft royal decree consists of a preamble, fifteen articles, a transitional provision, two final provisions, and four annexes.

Only the responses in which the sender is identified will be considered, stating in them:

  • Name and surname/denomination or social reason of the participant

In general, the contributions received will be considered to be open to public dissemination. The parts of the information submitted that, in the opinion of the interested party, should be treated confidentially and therefore should not be freely disseminated, should be specifically indicated in the text of the contribution itself, not considering for this purpose the generic messages of confidentiality of the information.
